Unfortunately, debt collectors can resort to tactics which are abusive and unlawful. The Fair Debt Collection Practices Act requires debt collectors to operate in accordance with the statute. Under this federal law, it is illegal for a debt collector to:

  • Communicate with your employer, relatives or friends about your debt unless the court has given the collector permission to do so.
  • Debt Collectors may not disclose to 3rd parties that they are seeking to collect a debt from you.
  • Work Contact and Phone Calls?
  • Debt Collectors Cannot contact you at work if the collector knows that your employer prohibits personal calls, or that you wish not to be contacted at work.
  • Cell Phone Robo-Calls
  • Debt Collectors cannot call your cell phone using auto dialers/robo dialers if you have instructed them it is your cell-phone and you do not wish to be contacted on this number.
  • Contact you at inconvenient times or places.
  • Debt Collectors cannot call before 8:30 am and after 8:00 pm
  • Falsely represent the character, amount or legal status of a debt
  • Debt Collectors cannot inflate debts with improper interest and fees
  • Threaten to take actions that are illegal or not intended.
  • Debt Collectors cannot threaten the use of the Police against you or family members.
  • Debt Collectors cannot threaten to file a law suit unless they are intending to do so.
  • Use obscene or profane language.
